Our Network is comprised of various websites, such as Só Canudos, A Rainha da Festa, Lotus Flower Cup, Cup with attached lid, and others, listed on the website: https://ngroup.works (referred to as "ngroup.works Network"). Here we describe how we collect, use and manage your information when you use our services, website, apps and our software ("Services").

The ngroup.works Network is a service platform, integrated with a marketplace, that allows members to buy and sell on the integrated marketplace.

Our CAU serves to centralize our communications, whether made in text messages, Whatsapp, voice and email. Due to the provision of our CAU, we reserve the right to express our responses only in our CAU, except for Reclame Aqui and other similar companies.

This "Terms of Use" ("Agreement") establishes the legally binding terms for your use of ngroup.works Network services. By using ngroup.works Network services, you agree to be bound by this agreement and terms of use, whether you are a "Visitor" (which means you will simply browse one of the ngroup.works Network websites) or you are a "Member" (which means you have registered on the ngroup.works Network or one of its subsidiaries). The term "User" refers to a visitor or a member. You are only authorized to use ngroup.works Network services (regardless of what your access or use is intended for) if you agree to comply with all applicable laws of this agreement and terms of use.

This "Terms of Use" agreement includes: "Privacy Statement", "Acceptable Use" and "Marketplace Terms", and cannot be disassociated under any circumstances.

The ngroup.works Network may modify this agreement from time to time and such modification will be effective upon publication by ngroup.works Network on its website, as well as on all its subsidiaries.

The ngroup.works Network reserves the right: at its sole discretion, to reject, refuse to post, or remove any post (including private messages) by you, or to restrict, suspend or cancel your access to all or any part of ngroup.works Network services at any time, for any reason or cause, with or without prior notice and without implying any type of legal, civil and monetary liability.

Designation: Any designation of ngroup.works Network in this "Terms of Use" refers to a legal entity of private law according to the laws of the Federative Republic of Brazil, NGROUP.WORKS SERVICOS LTDA, registered with the CNPJ under number 21.173.065/0001-09 and NIRE number 121.010.707.111, with a branch in the United States of America, responding jointly with the brands "ngroup.works", "Só Canudos", "Lotus Flower Cup", "Cup with attached lid", "A Rainha da festa", "Kit Gay", "Cura Gay" also with registered trademarks in Brazil and some globally. In accordance with LAW No. 13.709, OF AUGUST 14, 2018, we declare that the legal entity referred to is the data controller.

Eligibility: When using ngroup.works Network services, you declare and warrant that (a) all registration information you submit is true and accurate, (b) you will maintain the accuracy of such information, (c) you are 12 years of age or older, and (d) your use of ngroup.works Network services does not violate any applicable law or regulation in your country.

Term: This agreement will remain in full force and effect while you use ngroup.works Network services or are a member.

Password: When you sign up to become a member you will be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You agree to notify ngroup.works Network immediately if you suspect any unauthorized use of your account or access to your password.

Non-commercial use by users and members: ngroup.works Network services are for personal and professional use by properly constituted companies in their countries of operation. Illegal and/or unauthorized use of ngroup.works Network services is prohibited.

Property Rights over ngroup.works Network Content

1. The ngroup.works Network does not claim any property rights in the text, images, files, photos, video, sounds, musical works, authored works, or any other materials you submit to ngroup.works Network services.
2. You declare and warrant that you own the rights to the content posted by you on ngroup.works Network services and/or have the right to grant the license herein.
3. ngroup.works Network services contain content from ngroup.works Network and its affiliates. This content is protected by copyright, trademarks, patents, trade secrets and other laws.
4. ngroup.works Network services contain content from users or members and other licensees. Except for content posted by you, you may not copy, modify, translate, publish, transmit, distribute, perform, display or sell any content.

Published content: The ngroup.works Network may delete any content that, at its sole discretion, violates this terms of use or that may be offensive, illegal or violate the rights, harm or threaten the safety of any person.

Copyright policy: You may not submit, modify, distribute or reproduce in any manner any material protected by copyright, trademarks or other confidential information belonging to third parties without the prior written consent of the owner of such proprietary rights.

Disputes between users and members: You are solely responsible for your interactions with other users and members of the ngroup.works Network.

Hosting: The services are hosted on Hostgator and Microsoft Azure servers, spread around the world.

Availability: We strive to provide excellent services, but there are certain things we cannot guarantee. The services are provided "as is".

SLA — Problem Resolution Policy

• Soft: when there is a noticeable bug but there is another way to perform the action. Deadline: from 7 days to 1 month.
• Critical: when there is a bug that partially prevents an action. Deadline: from 48 hours.
• Blocker: when the user cannot access the system due to a complex error. Deadline: from 1 hour to 7 days.

Disclaimers: The ngroup.works Network is not responsible for any incorrect or inaccurate content posted on one of ngroup.works Network websites.

Limitation of Liability: Under no circumstances will ngroup.works Network be liable to you or any third party for any damage or repair.

Indemnification: You agree to indemnify and hold harmless ngroup.works Network, its subsidiaries and affiliates, their respective directors, agents, partners and employees from any type of liability.

European Union Legislation

All ngroup.works Network services meet the criteria and guidelines of the "Article 29 Working Party", an entity that brings together the main data protection regulatory bodies of the European Union.

Brazilian Legislation

In compliance with Brazilian legislation, notably Law 12,965, of April 23, 2014, which establishes the principles, guarantees, rights and duties for the use of the Internet in Brazil, known as the 'Civil Rights Framework for the Internet', ngroup.works Network complies with all its legal requirements.

In accordance with LAW No. 13,709, OF AUGUST 14, 2018 (LGPD), the user agrees with the processing and storage of personal data as described in this "Terms of Use" document.

Data deletion: For effective deletion of data, the user must request ngroup.works Network through its CAU.

The "ngroup.works", "Só Canudos", "Lotus Flower Cup", "Cup with attached lid", "A Rainha da festa", "Kit Gay", "Cura Gay" are registered trademarks of ngroup.works Network under the laws of the Federative Republic of Brazil. The jurisdiction is hereby elected as the court of the city of Santo André - São Paulo, in the Federative Republic of Brazil.

For all purposes of this term, the original Portuguese version of Brazil will be used to resolve any doubt, alteration and misunderstanding.

The purpose of this document is to clarify what information is collected from users of our website, applications (apps) and respective services, and how this data is handled and used.

Data We Collect (and why)

Information provided by you: We collect personal identification information – such as name, phone, email, ID and similar – through filling out forms on our free or paid content.

This term allows ngroup.works Network to use your personal information for different purposes. The email is used for the operation of sending the material or information requested by you when filling out the form.

The ngroup.works Network also commits to not selling, renting or sharing your information with third parties. The only exception is in cases where this information is required by court order.

Changes to Privacy Policy

Thank you for using the ngroup.works Network Marketplace. Below we inform you of the Marketplace Terms of Use that are essential for use, whether you are an Advertiser, Buyer or Seller on the marketplace.

1. Definition

The ngroup.works Network Marketplace is an e-commerce platform where Users, Advertisers, Buyers and Sellers can buy and sell products and services using unified payment and various logistics solutions.

The ngroup.works Network is not a supplier of products or services advertised and offered on the website (except for the Cup with attached lid which is owned by ngroup.works Network with licensing agreements).

2. About advertisements

Product/service advertisements must clearly contain title, description, image, price, category, quantity available or availability period, sale conditions, method and delivery period.

3. Prohibitions

The advertisement of products expressly prohibited by applicable local legislation or by ngroup.works Network Terms of Use is not permitted. The advertisement of products and services that violate the rules of competent regulatory bodies in the location of advertisements and sales is prohibited.

4. Seller Obligations

1. Respect the conditions of sale published on the website.
2. Issue Invoices, Invoices and any type of local documentation that leads to tax payments.
3. Guarantee the right of cancellation within the legal period.
4. Respect applicable legal warranties described in the advertisement.
5. Pay the costs of revocation, exchanges and/or returns of products and services.

5. Return Policy

The consumer may withdraw from the contract within 7 calendar days from its signing or from the act of receipt of the product or service, whenever the contracting of supply of products and services occurs outside the commercial establishment.

6. Tax Obligations

It will be the responsibility of the Seller, when applicable, to effect the proper withholding and collection of all taxes at the time of shipment of products.

For all purposes of this term, the original Portuguese version of Brazil will be used to resolve any doubt, alteration and misunderstanding.

Your profile on ngroup.works Network cannot include the following items: photographs and tasteless paintings, videos or other media containing unacceptable nudity, or obscene, violent scenes, harassment or any other sexually explicit or objectionable content.

Prohibited Content/Activities

The ngroup.works Network reserves the right to investigate and take appropriate legal action against competent authorities against anyone who violates this provision.

Prohibited content includes, but is not limited to content that, at ngroup.works Network's sole discretion:

1. Is offensive and promotes racism, intolerance or physical harm of any kind against any group or individual.
2. Harasses or advocates the harassment of another person.
3. Exploits people sexually or violently.
4. Contains inadequate nudity, violence or offensive material.
5. Requests personal information from minors.
6. Promotes information known to be false and/or misleading or promotes illegal activities.
7. Promotes illegal or unauthorized copying of the copyrighted work of another person.
8. Involves the transmission of "junk mail", "chains" or unsolicited bulk correspondence.
9. Contains restricted access pages or passwords or hidden pages or images.
10. Promotes or advocates any criminal activity.
11. Requests passwords or personal identification information for commercial or illegal purposes.

Prohibited Activities

1. Criminal or torturous activity, including child pornography, fraud, trafficking in obscene material.
2. Advertising for, or requesting any user or member to buy or sell any products or services without express consent.
3. Covering or obscuring banner advertisements on your personal profile page.
4. Any automated use of the system, such as using scripts to add friends or send comments or messages.
5. Interfering with, interrupting or creating an overload on ngroup.works Network's website or services.
6. Attempting to impersonate another user or member.
7. Selling or transferring your user or member profile without the express consent or authorization of ngroup.works Network.
8. The use of any information obtained from ngroup.works Network services to harass, abuse or harm another person.
9. Using ngroup.works Network services in a manner inconsistent with all and any applicable laws and regulations.

For all purposes of this term, the original Portuguese version of Brazil will be used to resolve any doubt.

For everyone who makes the order, but not the entry into the Content Creator Program, the curation of ngroup.works Network is autonomous and irrevocable.

Additional terms apply only to Content Creators approved by ngroup.works Network's curation, as follows:

1. Definition

The Content Creator Program ("CCPP") is a rewards program through the execution of sales through ngroup.works Network websites. It is intended to remunerate content creators who actively promote ngroup.works Network products.

2. Requirements to participate

• Accept the Terms of Use and wait for activation of the DISCOUNT COUPON by ngroup.works Network curation.
• Issue an Invoice for Intermediation Services or Advertising Services from a company in your name.
• Be over 18 years old.
• Have more than 2 thousand followers on one of the networks: TikTok, Instagram, Linkedin or Facebook.
• Make at least one monthly post about ngroup.works Network products and services.

3. Operation

Content creators will receive items to advertise and must include the PROMOCODE or DISCOUNT COUPON in their advertisements. No sales will be revised under any circumstances without the use of the COUPON.

4. Duration

The Content Creator's adherence period to the CCPP has no expiration date, but ngroup.works Network may unlink the Content Creator with prior notification of 30 calendar days.

5. Payments

Payments to Content Creators will be made by database, that is, after 30 days, ngroup.works Network will send an Invoice request for all amounts collected 30 days before. After receiving the Invoice, ngroup.works Network will make the payment on the 15th of each month or the previous business day.
